Tier II Reporting
Section 312(a) of the Emergency Planning and Community Right-to-Know Act (EPCRA) of 1986 requires certain facilities to submit their emergency and hazardous chemical inventory forms by March 1 of each calendar year to their State Emergency Response Commission (SERC), their Local Emergency Planning Committee (LEPC), and their local fire department. In Kentucky, this is done virtually using HazConnect and is then forwarded to the agencies that need it.
Facilities must report any Extremely Hazardous Substance (EHS) that was present at any time in the previous calendar year in quantities ≥ 500 pounds or its Threshold Planning Quantity (TPQ), whichever is lower. Additionally, the reporting obligation applies to any facility that is required by OSHA to have a Safety Data Sheet (SDS) for any onsite hazardous chemical that was ever present in the previous year in quantities ≥10,000 pounds. Finally, gasoline and diesel stored in underground tanks at retail gas stations have higher thresholds to reduce reporting burden; gasoline must be reported if 75,000 gallons or more are stored, and diesel if 100,000 gallons or more.
The requisite reporting is covered by two “tiers” that provide information on hazardous chemicals at the facility. The Tier I form contains general information on hazardous chemicals at the facility. The Tier II form contains specific information on hazardous chemicals present at the facility.
How to submit Tier II Report:
Kentucky’s Tier II reporting is administered by Kentucky Emergency Management which uses the HazConnect online reporting platform available at https://kentucky.hazconnect.com/Account/Login.aspx. A Kentucky facility’s online HazConnect submittal is forwarded to its LEPC and to its local fire department (as designated in the application), so the one online submittal meets all of a facility’s Tier II reporting obligations.
The reporting season opens on January 1 of each year, and facilities must report their previous year’s hazardous chemical inventories via HazConnect by March 1. Any reports submitted after the March 1 deadline will be subject to a $250 late fee per facility.
